PREFACE
A lot of time and energy by unpaid volunteers goes into each exhibit in the Gallery at the CCC. That is why we must have these policies in place to ensure that all the artists are treated the same, that all artists are represented in the best possible way, and that both the artists and the Gallery at the CCC benefit from these exhibits.
TERMS & CONDITIONS - CORTEZ CULTURAL CENTER
When you submit your artwork for any upcoming art exhibits in the Gallery at the CCC (Gallery), you are agreeing to the following terms and conditions:
- Artists must ensure that they are able to meet all deadlines and dates before submitting artwork for any exhibit.
- Artwork must be an original concept by the artist. Artists may only submit artwork that they personally created or originated.
- We will consider all generally acceptable forms of art and fine crafts, such as but not limited to: paintings, sculptures, photography, pottery, glass, metal, wood and fiber crafts, mixed media, upcycled and recycled art, etc.
- Each submission must include the following:

- Title of the Artwork
- Medium (Oil on Canvas, Mixed Media, Photography, etc)
- Outside Dimensions (Width x Height x Depth, including frame if applicable)
- Suggested Retail Selling Price (see special notes regarding pricing, below)
- If your artwork is accepted to be displayed in the exhibit, you must also submit an "Artist Bio/Statement" that will be displayed with your artwork. You may include a photo (optional, but highly recommended). You can find the link to the online form to submit your artist bio/statement on our website at cortezculturalcenter.org/exhibits, as well as in the online forms for submitting artwork for each of the open-call themed exhibits.
- If the artwork sells, the CCC will retain 40% of the retail price as the standard consignment fee, with 60% going to the artist (this fee is based on the industry standard for fine art galleries, which is 40-50%). The consignment fee for CCC members is 35%, with 65% going to the artist.
- The CCC will maintain responsibility for receiving payment and collecting and remitting State and City sales tax.
- The cost of shipping any artwork (if applicable) will be borne by the purchaser, if sold, or by the artist if unsold and requested.
- Artists are responsible for delivering and picking up their artwork on the dates and times established for each exhibit, NO EXCEPTIONS!

- Failure to drop-off artwork during the predetermined date and time for an exhibit or any attempt to drop off artwork outside of the predetermined date and time without prior approval from a member of the Curator Team will preclude the artwork from being included in that exhibit, and it may result in the artist being suspended from exhibiting in the Gallery.
- If unsold artwork is not picked up on the predetermined date and time of pick-up without prior arrangement through a member of the Curator Team, it may result in the artist being suspended from exhibiting in the Gallery.
- If you think that you may not be able to meet the load-in and/or pick-up dates and times, you may authorize a friend or an associate to do that for you so that you don't miss the deadlines. If you believe there is a good chance that you may not be able to meet the date requirements for a given exhibit, we suggest that you simply do not submit artwork for it. You may not be invited to exhibit in future shows if your artwork is accepted, but you fail to meet the deadlines, especially if it becomes a frequent occurrence.
- Artists must sign an inventory sheet confirming the artwork title, medium and pricing at the time of load-in of their artwork. Artwork and items in the CCC are insured against fire, breakage, theft and loss; however, it is the artist's responsibility to keep their own copy of their inventory in the event of such loss. (We suggest the artist take a photo of the inventory sheet with their cell phone after they've reviewed and signed it.)
- Artwork must be "gallery ready" when dropped off. This means it must be properly framed and/or otherwise presentable for fine art gallery display with proper hanging apparatus attached and/or supports provided. Wire strap across the back is the preferred method for hanging art. Non-hanging artwork must be freestanding on its own or the artist must provide proper easels, stands or other supports.
Work-Specific Exclusivity and Non-Competition Clauses
- All original artwork in which there is only one piece to sell may NOT be offered for sale elsewhere while it is on display for sale in the Gallery at the CCC (in other words, artwork that is uniquely one-of-a-kind and not a print, photograph or something created in multiple identical pieces). This means you must remove any other online listings where that piece is for sale, including online stores, social media sites, etc.
- Artwork submitted for display in the Gallery must have a Suggested Retail Selling Price that is the same price that the artwork would be offered for sale in any other “regional area” galleries, retail shops, and public exhibition spaces (library, recreation center, banks, restaurants, etc.). “Regional area” for the purpose of this rule is any place within a 60-mile radius of Cortez. In the last section of this document, you will find the philosophy behind having a Work-Specific Exclusivity Clause and a Non-Competition Clause and why they are beneficial to both the Artists and the Gallery.
- Only artwork that has been accepted by the Curator Team may be placed in the Gallery.
- Unsold artwork may not be removed from the CCC gallery before the exhibition ends, nor may it be picked up outside the designated date and time for pick up without prior arrangement with one of the curators.
- The names and contact info for the responsible Curator Team members are listed at the bottom of this document.Artists must contact one the Curator Team members for any questions or concerns about exhibiting their artwork in the Gallery at the CCC, including:

- Changes to any artwork that has been submitted for an exhibit.
- Changes to any artwork in an exhibit once the artwork has been installed.
- The Curator Team will have final say in determining which pieces are accepted for the exhibits. Items deemed inappropriate or not in line with the theme of the exhibit will be not be accepted. Items that the Curator Team determine are not "Gallery Ready" will not be accepted. Acceptance also depends on the amount of wall space available and the number of pieces submitted.
- The Curator Team may choose not to accept artwork if they believe that the “suggested retail selling price” is far above the “fair market value” for the area. Several factors may be used to determine “fair market value”, including but not limited to: comparable sales of similar artworks, the quality and scope of the artwork, and the artist's reputation and representational history.
- Artists consent to the use of their name and/or photograph(s) of their artwork by the CCC for advertising and marketing purposes.
- Your artist bio/statement will be displayed with your artwork. No other promotional materials may be displayed with your artwork in the Gallery. This includes business cards, flyers, brochures, etc.
- Artists may not run their own advertising campaign, nor send out press releases or articles relating to the exhibitions in the Gallery at the CCC without prior approval from the Curator Team. Artists may promote the exhibition on their social media and through their personal contacts, as they wish, but we request that they include a link to the CCC's website or Facebook page when doing so.

- If your artwork is sold, we will ask the buyer if they would allow the piece to remain in the Gallery until the exhibit ends (we will place a "sold" sticker on the artwork). If the buyer is traveling through or does not wish to leave the artwork up through the end of the exhibit, you may be given the option to replace it with another piece of artwork of similar size that fits the theme of the exhibit.
- Payment for artwork sold is generally processed around the 15th of the month following the month in which the artwork was sold.
- Unsold artwork not picked up within one month of the predetermined pick-up date will be sold and the proceeds will be considered a donation to the CCC.
- Artists are strongly encouraged to attend the opening receptions for the exhibits in which they have artwork, as well as the other opening receptions to show support for their fellow artists and the Gallery at the CCC.
Gallery at the CCC ~ Consignment Philosophy
NOTE: This philosophy is based on industry standards!
Why We Have a “Work-Specific” Exclusivity Clause:
We require that all pieces of artwork being displayed in the Gallery at the CCC be exclusive to the Gallery at the CCC and not be offered for sale elsewhere (including online) while the artwork is on display, as this has caused a conflict in the past when a piece was sold privately by the artist to an outside buyer and it was taken out of the exhibit before the exhibit was over. The CCC did not get a commission on the sale, in spite of the time, energy and efforts that went into setting up the exhibit and working with the artist to professionally display and promote their artwork.
Why We Have a Non-Competition Clause and Why Your Artwork Pricing Should Be Consistent (regardless of where you exhibit in a given regional market area):
Artists should price their work the same across all stores, galleries, and their own websites to build buyer trust, maintain strong gallery relationships, and protect the perceived value of their art. Consistency ensures buyers feel secure that they are paying a fair, verifiable price no matter where they discover the piece.
Maintaining unified pricing across all channels is critical to artists for several key reasons:
· Protects Gallery Relationships: Galleries invest significant time, energy, and physical space into marketing your art. If you undercut them by selling the same pieces cheaper at other regional venues or on your own website, you risk ruining those relationships and being dropped by your representatives.
· Preserves Buyer Trust: Collectors frequently research an artist's pricing history. If a buyer discovers your work is cheaper in one store than it is in another, it makes them feel cheated and severely damages your credibility as a professional.
· Upholds Perceived Value: In the art world, price dictates status. Pricing your work consistently builds a brand. If you fluctuate prices, you devalue the artwork to the lowest price you ever offered, which makes future collectors hesitant to pay top dollar.
· Removes Buying Friction: Buyers are less likely to inquire about a piece if they feel confused or fear they are overpaying. A unified price sheet gives collectors confidence in your career and trajectory. [1]
To maintain this balance without shortchanging yourself on different platforms, experts recommend setting a standard retail price that accounts for the highest commission fees you might pay.
